Given the troubles Florida's real estate market has faced over the past few years, tax deed and foreclosure sales are increasingly common. In some of these cases, there are questions as to who actually owns the property. It is therefore crucial that any purchaser of real estate understands what exactly he or she is purchasing. If you have recently purchased property or are contemplating purchasing a distressed property, a lawyer can help you make certain you have clear title to the property.

Fort Myers quiet title action attorney James Puccio of Puccio Law represents property owners across Southwest Florida. The firm maintains a broad-based real estate practice and has helped numerous investors across the region make certain they have free and clear title to any piece of property.

Unfortunately, it is not uncommon for the same property to be sold numerous times to different owners. Consequently, it is possible for numerous parties to claim the right to title. This is particularly the case with distressed properties. A quiet title action can confirm who the lawful owner of the property is. If you have just purchased a distressed property, Puccio Law can bring a quiet title lawsuit to establish that you are the rightful owner of the property.

Puccio Law also advises individuals and businesses prior to purchasing property. Mr. Puccio can do a judgment and lien search to determine if there are any judgments or liens against the former owners of the property. James Puccio is a mortgage broker and real estate broker as well as a lawyer, and he has the legal and business knowledge necessary to provide sound advice and counsel.

Landlord-Tenant

Disputes between commercial tenants and landlords happen all too frequently. These disputes can involve any number of issues, including a tenant's failure to pay rent, a landlord's failure to make repairs or the failure of either party to honor the terms of the lease. These disputes can bog down a business and cost both money and time.

If your company is involved in a dispute over a commercial lease, it is vital to have an experienced lawyer on your side. Commercial tenants and landlords have relied on Puccio Lawfor its effective, efficient resolution of these disputes. Based in Fort Myers, our landlord-tenant attorney guides businesses across Southwest Florida through these challenging disputes.

James Puccio has practiced law for more than 30 years. Over this time, he has developed a strong real estate practice, meeting the needs of landlords and tenants alike. Mr. Puccio is also a licensed mortgage broker and a licensed real estate broker. This "real-world" experience adds value and insight to his representation. In his landlord-tenant practice, he has served clients in several major disputes in shopping centers and understands the issues involved in these claims.

Above all, Mr. Puccio recognizes that litigation is not always the most appropriate means of resolving disputes between commercial landlords and tenants. Frequently, negotiations between the parties can resolve the underlying issues and allow both parties to move forward on favorable terms. Mr. Puccio will identify the best possible strategies at the outset of your case to seek a positive, expeditious resolution.

In today's challenging economic climate, more and more homeowners are struggling to keep up with their mortgage payments. In turn, this increases the occurrence of foreclosure proceedings nationwide. Foreclosure adversely affects both homeowners and lenders. For homeowners, you would rather not lose your home to foreclosure, in addition to the lasting impact it has on your credit and future financial well being. For lenders, a home foreclosure only adds to inventory and does very little to improve the overall financial situation.

Attorney James Puccio believes that mortgage foreclosure is a serious problem for those on both sides of the table. Whether you are a homeowner who has received notice of foreclosure and wish to fight the process, or you are a lender seeking to recover compensation on a defaulted loan, James Puccio has the knowledge and ability to guide you through the process as efficiently and painlessly as possible. Contact Fort Myers Attorney Puccio online or call 239-995-0000 for a consultation.

With over 30 years of legal experience and a background in real estate and business, James Puccio is a lawyer that can offer insightful, industry-honed guidance to lenders and homeowners at various stages of the mortgage foreclosure process. He serves clients in a variety of areas, including:

  • Filing mortgage foreclosure lawsuits

  • Defending foreclosure lawsuits

  • Truth in Lending Act violations

  • Mortgage fraud

  • Mortgage modification

  • Short sales

  • Loan modification

  • Deficiency judgments

  • Wrongful foreclosure

Through Mr. Puccio's years in practice, he knows that every situation is unique. With this in mind, he strives to understand your specific situation, your concerns and your goals before offering the advice you need to get through the foreclosure process.

The American Disabilities Act of 1990 was designed to combat discrimination against people who are impaired.

The Americans with Disabilities Act (ADA) defines a disability as “a physical or mental impairment that substantially limits one or more of the major life activities of such individual.” Title III of the ADA “prohibits discrimination on the basis of disability by public accommodations and requires places of public accommodation and commercial facilities to be designed, constructed, and altered in compliance with the accessibility standards established by [the ADA].”

Florida is an at-will employment state, meaning that employers can terminate an employee for any lawful reason. The key word in this statement is lawful. Employers cannot terminate an employee based on race, sex, age, religion, disability or membership in another protected class.         Employers cannot fire an employee in retaliation for reporting an illegal act or refusing to go along with an illegal act.

If you have reason to believe you have been wrongfully terminated or if a former employee is accusing your company of wrongdoing, it is critical to have an experienced lawyer on your side. Contact Puccio Law at 239-995-0000 to assist you.

For many years, Fort Myers wrongful termination attorney James Puccio of Puccio Law has represented employers and employees in employment claims. His experience and knowledge of these claims provide a distinct benefit to employees and employers alike.

People who question their employer's illegal actions, or actions they believe to be illegal, are courageous individuals. Unfortunately, in many cases employees who report wrongdoing are faced with retaliatory discharge. For example, employees who report wage and hour violations such as unpaid overtime, payment "off the books" or other illegal activities are fired in response.

Whether representing an employee who has been wrongfully terminated or defending an employer against these accusations, James Puccio will fully investigate the case. He will interview witnesses and review all available documentation to determine the substance of the claim. In many cases, resolving the case through a negotiated settlement is the best way to proceed. If necessary, he will be prepared to proceed to trial to enforce your rights. However your case is resolved, know that Mr. Puccio will deliver his best effort, based on more than 30 years of legal experience, to give you the strongest chance of achieving a favorable outcome.

Wrongful Termination

As the employee of a company, you are entitled to be paid a fair wage for the hours you work. If you are not being paid the wages you are owed or have been expected to work "off the clock," you may need help from a skilled Fort Myers hour and wage dispute lawyer to assert your rights.

With more than 30 years of legal experience, Fort Myers Attorney Puccio of Puccio Lawo has been dedicated to representing employees in the Fort Myers and Cape Coral area, as well as throughout southwest Florida. He strives to protect the rights of employees who are owed wages and overtime pay by their employers.

Under state and federal laws, employees are to be paid a fair wage for the hours they work, including overtime and "off the clock" work. Additionally, they are to get breaks for meals and rest periods. If your employer is not paying you what you deserve, if you have been forced to work without a break, or if you have been working overtime without getting paid, talk to attorney James Puccio about your rights and options. He effectively represents employees who are involved in wage and hour disputes involving:

  • Unpaid wages

  • Unpaid overtime

  • Unpaid breaks

  • Unpaid meal time

  • Unpaid commissions

  • Failure to pay mandatory minimum wage

As an employment rights attorney, James Puccio can bring forward a strong claim on your behalf, help you collect your unpaid wages or overtime, and help you collect any additional pay if applicable.

Wage and Hour Law

Disputes between business partners or shareholders in a closely held corporation can be distracting and financially draining. These disputes may even lead to dissolution of the company. If you are involved in a dispute with a business partner or other shareholders, it is important to work closely with a lawyer who is able to effectively address all of your concerns.

By understanding the business implications of any dispute, James Puccio can advise clients as to the best possible means of resolution in the earliest stages of litigation.

A shareholder derivative suit allows a shareholder in a company to bring a lawsuit on behalf of the company. Typically, minority shareholders in a closely held company will bring a derivative lawsuit against the majority shareholders. A derivative suit may allege all types of wrongdoing, including:

  • Breach of fiduciary duty

  • Fraud or misrepresentation

  • Breach of contract

Partnership disputes can involve many of the same issues. Puccio Law prosecutes and defends shareholder derivative suits for closely held companies and partnership disputes. James Puccio understands that litigation can be incredibly costly to a business. As such, he works to resolve these matters outside of court whenever possible. When the parties cannot reach common ground, Mr. Puccio has the litigation experience to make a compelling case.

Many shareholder and partnership disputes involve one or more partners wishing to leave the company to pursue other endeavors. In these cases, the terms of a noncompete agreement may be a controlling factor. James Puccio will review the terms of any noncompete agreement and advise his clients as to the best course of action. Shareholders and Partnerships

It happens to almost everyone at one time or another in our lifetime. We believe in someone, whether it is the purchase of real estate, a major purchase, terms of a contract, a business transaction or a contract or promise that was not fulfilled. In many such situations there are legal remedies that are available to protect the victim by law.

Over the years Fort Myers Attorney Puccio of Puccio Law has been involved in cases where the real estate agent "failed" to mention to the purchasers that the house had a septic tank rather than being connected to the city sewer system. It may seem humorous, but to the family that purchased the home, the additional expense and effect upon the value of the property was disappointing, and as you can imagine, shocking when they learned it would cost them thousands of dollars to repair underground leakage from the tank.

In another unusual situation a client purchased a townhome in an upscale community. After several months in his new home he received a NOTICE OF LIEN that was filed against his property that was filed by the attorneys who represented the Home Owner's Association. Although he trusted his real estate broker, and was comfortable with the closing transaction, he now found that there was a possibility that the lien could be foreclosed and he could lose his home. Puccio Law's client had "title insurance" and never saw anything that called the title or ownership of the property in doubt.

When the home owner contacted the attorneys who served the notice of lien upon him, he learned that there was a "master home owner association" in addition to the local association that he routinely paid his dues and maintenance fees. Although there was a lien against the real estate, the title company missed it when it searched the public records during a lien or judgment search. After more than one year of fighting with the title company, receiving letters from the attorneys for the Homeowner's Association with bills showing accumulating costs, fees, interest, and attorney fees he was liable to pay, and worst of all, the lien openly appearing in the public records he finally sought the advice and assistance of an attorney.

After aggressively pursuing the title company it finally conceded its liability, accepted responsibility and reached a settlement with the Homeowner's Association, paid the arrearages that were being charged to Puccio Law's client, and at last the client had the peace of mind that the lien that threatened the loss of his home was released. Resolving the problem not only released, but it also erased the negative impact upon his personal credit.
