Although he trusted his real estate broker, and was comfortable with the closing transaction, he now found that there was a possibility that the lien could be foreclosed and he could lose his home. When the home owner contacted the attorneys who served the notice of lien upon him, he learned that there was a "master home owner association" in addition to the local association that he routinely paid his dues and maintenance fees. After more than one year of fighting with the title company, receiving letters from the attorneys for the Homeowner's Association with bills showing accumulating costs, fees, interest, and attorney fees he was liable to pay, and worst of all, the lien openly appearing in the public records he finally sought the advice and assistance of an attorney.
After aggressively pursuing the title company it finally conceded its liability, accepted responsibility and reached a settlement with the Homeowner's Association, paid the arrearages that were being charged to Puccio Law's client, and at last the client had the peace of mind that the lien that threatened the loss of his home was released.
